This "Member Agreement" is a LEGAL AGREEMENT between 'you', the end user, or “Member” and Scum Gaming (also referred to as "SCUM", "we", "our", "Scum.co.uk",  "website", or "us"), which sets forth the terms and conditions governing your participation on the website. By visiting, viewing, using, accessing, or registering as a "Member" or "member" either on the forum site, gaming site, or commerce site, you agree to be bound by all of the terms and conditions of this Member Agreement. Use of the content on Scum.co.uk of which you are about to read, provide feedback, downloading materials or data, uploading materials or data, or installing or using materials or data indicates your acceptance of this Member Agreement. This web site and all of its content, whether directly or indirectly, is provided to you "as-is" with no warranty expressed or implied. If you do not agree to be bound by the terms and conditions set forth in this Member Agreement, do not access, view, or use SCUM.

We can and will amend this Member Agreement by posting the amended terms and conditions on SCUM, which take effect as soon as they are posted. By continuing to access or use SCUM after the amended terms and conditions are posted, you agree to be bound by the terms and conditions of the amended Member Agreement. We recommend you print a copy for your reference and check back periodically for updates.

Viewing

This site was developed with multiple browser technology in place and should work with most browsers. To ensure proper display of SCUM, please use Firefox 2.5 or higher or Internet Explorer 7.0 or higher. Property

SCUM is copyrighted by Scum.co.uk. Scum Gaming logo is Trademarked. You may not use this logo for any purpose unless you receive EXPLICITE CONSENT and sign a usage agreement from the administrators. All material provided on SCUM is protected under United Kingdom (England and Wales) and United States copyright laws which include international copyright laws and treaty provisions except where expressly provided within this document, none of the material provided on SCUM may be copied, distributed, republished, reproduced, modified, downloaded, displayed, transmitted or “hot-linked” in any form for commercial use without the prior written permission of Scum.co.uk. Individual visitors of SCUM are permitted to download or print one copy of material published on SCUM solely for their personal, non-commercial use, provided that they do not modify the materials and that they retain all copyright and other proprietary notices contained in the downloaded materials. This permission terminates automatically if you breach any of the terms and conditions contained within this document. Scum.co.uk does not grant any expressed or implied right to you under any patents, trademarks, copyrights or trade secret laws.

The trademarks, logos and service marks (collectively referred to as "Trademarks") displayed on SCUM are claimed by Scum.co.uk and no trademark license, either expressed or implied, is granted by Scum.co.uk. You do not have any right to use any Trademark displayed on SCUM except as expressly provided in written permission by Scum.co.uk. Should the event arise that unauthorized use or misuse of Scum.co.uk Trademarks, Scum.co.uk will pursue aggressive legal remedies.

Members

You as a Member may become a "Member" of SCUM, by completing the Member application form here for all Members. Becoming a Member allows you to post content on SCUM. You agree as a term and condition of use and membership that we may contact you for the purpose of informing you of changes to this Member Agreement or describe services, new and existing, that are available at Scum.co.uk. You are responsible for protecting the password that you use to access any area of SCUM. You agree not to disclose your password to any third parties. You agree to take sole responsibility for any activities or actions under your password, whether or not you have authorized such activities or actions. You will immediately notify SCUM here of any unauthorized use of your Member account. By becoming a Member and using Scum.co.uk, you certify that you are 18 years of age or older based on the calendar date YOU WERE BORN. If you are under the age of 18 years of age, do not register, access, view or use Scum.co.uk. We reserve the right to terminate your Member status in the event that SCUM determines that you are less than 18 years of age.

SCUM assists Members in providing and reading electronic game software and reviews, electronic and computer hardware and reviews, and associated content. SCUM provides information regarding these reviews and products. SCUM strives to ensure the accuracy of all information in these areas; however the content of these materials are provided for informational purposes only. We are not responsible for inaccurate reviews or listings. The content provided on SCUM is offered with the full understanding that Members will reference the respective manufacturer’s or developer’s websites BEFORE providing Member content. Members or guests should not rely on this information in situations where inaccurate or incomplete information would cause you to suffer any loss. The content of these listings are provided for informational purposes only. Scum.co.uk is not responsible for inaccurate or incomplete information. SCUM assumes no liability for inaccurate or incomplete Member published reviews, editorial content, forum content, or other content on SCUM. Any questions, complaints, or claims should be made here.

SCUM provides Member forums, Member review options, and Member electronic data submission option for our Members who have elected to post a review or content on SCUM. These electronic data, reviews and forum posts may be informative for those wishing to read or use them; however SCUM does not guarantee the accuracy of any Member post, Member written review, Member generated content, or Member submitted electronic data. SCUM reserves the right to remove Member posts, Member reviews, or Member provided electronic data that we identify as inappropriate in nature. A bad review or a bad software game does not necessarily constitute inappropriate content. We encourage honest opinions from all who may use Member available content at SCUM. SCUM reserves the right to cancel or ban a Member’s account with or without notice or reason. All Member generated content must be provided as original content from the posting Member. If content is used from another published source, reference of the source must be included. WE DO NOT RECOMMEND FOLLOWING LINKS listed in Member posts. SCUM can not guarantee the safety or content of the links that may be provided in Member content. All Member generated content will become property of SCUM with reference rights to the content providing Member. SCUM reserves the right to remove any Member generated content at our sole discretion with or without notice to Members. You are solely responsible for your interactions with other Members. SCUM reserves the right, but has no obligation, to monitor disputes between you and other Members.

Content Submission

Scum.co.uk, any affiliated persons, entity, officers or Member is in a position to investigate, censor or otherwise ensure the accuracy of any comments, remarks or other information and content (will be known collectively as "Content") posted or generated by a Member of SCUM, and therefore is not responsible in any way for such Content provided by Members. To the contrary, many of the Members are of unknown identity and have no relationship with Scum.co.uk. Therefore, Scum.co.uk expressly disclaims, on behalf of itself and any affiliated persons or entities, any guarantee, warranty, other representations or responsibility with respect to the authenticity, legitimacy, totality or lawfulness otherwise of any Content provided by Members of SCUM. SCUM further expressly disclaims, on behalf of itself and any related persons or entities, any guarantee, warranty, other representations or responsibility with respect to such Member Content as related to, among other things, intellectual property rights, copyright or trademark infringement, slander, libel, malign, invasion of privacy, criminal or tortuous activities otherwise. Therefore, Scum.co.uk does not assume (but expressly disclaims), on behalf of itself and any affiliated persons or entities, any liability of any kind for any alleged direct or consequential injury or damages arising from, or relating to in any way, the Content provided by Members or their activities otherwise, including, without limitation, any alleged liability under any federal or state criminal or civil laws. Each of SCUM’s Members acknowledges, by usage of SCUM, that you, the Member, is fully responsible and liable for your, the Member’s, Content, and neither Scum.co.uk nor any affiliated persons or entities are providing guaranties or indemnities of any such Member.

By submitting any content to SCUM you guarantee that you are the author and owner of the intellectual property rights thereto and you grant SCUM a worldwide, nonexclusive, perpetual, irrevocable, royalty-free, and transferable right and license to use, copy, modify, edit, delete (in whole or part) adapt, publish, translate, create derivative works from, and/or sell and/or distribute such materials and/or incorporate such materials into any form, medium or technology without compensation to you. In addition, you guarantee that you have waived all "moral rights" that you may have in materials submitted to SCUM. None of the materials shall be subject to any obligation of confidence on the part of SCUM, its agents, subsidiaries, affiliates, partners and their respective directors, officers, managers, employees and other Members. SCUM reserves the right to change, condense or delete any content on SCUM that we deem violates the content guidelines or any other provision of this User Agreement.
You retain all ownership rights to information, text, graphics, or other materials you publish on SCUM. However, we can reproduce, publish and distribute all or portions of your content online and offline and permit others to do the same. You can edit or remove your content from SCUM at any time; but if we have distributed your content to others, we may be unable to require them to make the same changes. We ask that you refer or provide links to SCUM if you choose to republish your content in another place and that you do not publish the same items of content on both SCUM and other web sites or publishing venue.

Termination

You can and may cancel your Membership at any time on SCUM. We reserve the right cancel your account at any time with or without notice, or otherwise refuse service to you, at any time for any reason whatsoever at the sole discretion of SCUM. Following termination of your account for any reason, at our sole discretion, SCUM may continue or delete any or your entire Member contributed content.

No Warranty

SCUM, ITS AFFILIATES, OFFICERS AND EMPLOYEES PROVIDE ITS WEB SITE AND SERVICES “AS IS” AND WITH NO WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. SCUM, ITS AFFILIATES, OFFICERS AND EMPLOYEES SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some areas do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. A warranty gives you specific rights and you may also have other rights that vary from location to location.

Limitation of Liability

IN NO EVENT SHALL SCUM, ITS AGENTS, SUBSIDIARIES, AFFILIATES, PARTNERS AND THEIR RESPECTIVE DIRECTORS, OFFICERS, MANAGERS, AND EMPLOYEES BE LIABLE ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF ITS WEBSITE, SERVICES, OR THIS AGREEMENT, INCLUDING ANY AND ALL CLAIMS FOR LOST PROFITS OR DAMAGES TO PROPERTY. Some jurisdictions do not allow exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Dispute Resolution

Any dispute between you and SCUM arising out of or in connection with your use of SCUM’s Content or services or this Agreement shall be resolved through binding arbitration administered by the London Court of International Arbitration or the American Arbitration Association in accordance with its applicable rules, or by any other established provider of alternative dispute resolution services as to which Scum.co.uk shall decide. Arbitration shall be conducted by email, on-line and/or based solely upon written submissions where no in-person appearance is required. Judgment on the award rendered by the arbitrator or arbitrators may be entered in any court having jurisdiction thereof.

Indemnification

By choosing to be a Member of Scum.co.uk, you agree to indemnify SCUM, its agents, subsidiaries, affiliates, partners and their respective directors, officers, managers, and employees against any and all claims or demands, including reasonable attorney's fees, made by third parties due to, or arising out of or in connection with your submission, posting or transmission of Member content on or through SCUM; or your use of or connection to SCUM; your violation of the User Agreement; or your violation of any rights of another.

Legal Compliance

You agree to comply with all applicable domestic and international laws, statutes and regulations regarding your use of SCUM’s Web site and services, and your purchase of items using SCUM’s Web site and services.

Miscellaneous

You agree to comply with all laws and regulations applicable to access the World Wide Web for using SCUM to and for providing your Member contributed content and other services provided by SCUM. You may not harvest personal data (including email addresses) from SCUM, and specifically you may not use email addresses displayed on our sites to ask users to join or contribute to your services. We have the right to investigate and we will prosecute violations of any of the above to the fullest extent of the law. We may involve and cooperate with law enforcement authorities in prosecuting users who violate the terms of this User Agreement. You acknowledge that SCUM has no obligation to monitor your access to or use of SCUM, but has the right to do so for the purpose of operating SCUM, to ensure your compliance with this User Agreement, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body. Unless we explicitly agree otherwise in writing on official letterhead in a certified letter, you may not use any automated means to access Scum.co.uk or collect information from it.
